Asda colleague handbook2/2/2023 ![]() ![]() In particular, the ET considered the following part of the staff handbook: In this test case, Asda justified its decision to unilaterally vary the terms of the employment contract by relying on provisions contained within the staff handbook, which formed part of the terms and conditions of employment. ![]() ![]() Most employees adopted this new regime, either willingly or forceably, but a small number claimed breach of contract and in some cases unfair dismissal, contending that they did not consent to the new regime. The employer, Asda, wanted to amend the contracts of existing employees so that their pay structure would be brought in to line with the more up-to-date ‘Top Rate’ regime. ![]()
